CLEVELAND – Police say their investigation is showing that First District Detectives were investigating a burglary and had information that a suspect who was in possession of property from the burglary and guns was in the 12200 block of Emery Road in a black Infiniti SUV.

Officers found the vehicle with the suspect inside and approached the SUV, identifying themselves as law enforcement officers.

The detective approaching the vehicle at the driver's side saw the suspect, later identified as Xavier Hampstead, 29, lean back and point the muzzle of a gun at him.

The detective, now identified as Robert Miles, 45, fired two rounds, striking Hampstead in the neck and chest/shoulder area. Miles is now on administrative leave.

Hampstead then drove off and officers pursued him a short distance until Hampstead stopped in the parking lot of a gas station at West 104th Street and Jasper Avenue. Detectives and uniformed officers in marked zone cars ordered Hampstead out of the vehicle. He did so and was taken into custody.

Hampstead was taken to MetroHealth Medical Center where he is listed in stable condition.
